NOTICE OF A COMPULSORY PURCHASE ORDER
Under Section 76 of and the Third Schedule to the Housing Act, 1966, as extended by Section 10 of the Local Government (No. 2) Act, 1960
Published in accordance with Article 4(a) of the Third Schedule to the Housing Act, 1966, as amended by the Planning and Development Act, 2000.
COMPULSORY ACQUISITION OF LAND
County Carlow CPO No. 1 of 2024 - N80 Leagh Bends Scheme
Carlow County Council (hereinafter referred to as “the local authority”) in exercise of the powers conferred upon them by section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by section 10 of the Local Government (No. 2) Act, 1960 as substituted by section 86 of the Housing Act, 1966 as amended by section 6 and the Second Schedule to the Roads Act, 1993 and as amended by the Planning and Development Act, 2000, have made an order entitled as above which is about to be submitted to An Bord Pleanála (“the Board”) for confirmation. If confirmed, the order will authorise the local authority to acquire compulsorily the land described in Part I (if any) and Part II of the Schedule hereto on a permanent basis and to compulsorily acquire the land described in Part III of the Schedule hereto on a temporary basis. This acquisition is necessary for the purposes of the construction of the N80 Leagh Bends Scheme from the townland of Graiguenaspiddoge to the townland of Castletown, traversing the townlands of Leagh or Ballybeg, Kilballyhue and Kilcoole all in the County of Carlow, together with all ancillary works associated therewith.
Owners, lessees and occupiers of the land described in Part I, Part II and Part III of the Schedules will receive individual written notice.
The order will also authorise the local authority to extinguish the public rights of way described in the Part IV of the Schedule hereto, by order made by them after they have acquired the land, where the said public right of way is over the land so acquired or any part thereof, or over land adjacent to or associated with the land so acquired or any part thereof.
Any objection to the compulsory acquisition of land described in the Schedule or to the extinguishing of the public rights of way referred to in the Schedule should be made in writing, stating the grounds of the objection to An Bord Pleanála, 64 Marlborough Street, Dublin 1, D01 V902 so as to reach the said Board before 4.00pm 31st January 2025.
The Board may, at its discretion, decide not to confirm –
- a compulsory purchase order in respect of the land if an objection is made in respect of the acquisition by an owner, lessee or occupier of the land, and not withdrawn, or
- an order which authorises the extinguishment of a public right of way if there is an objection to the extinguishment, which is not withdrawn,
until it has caused to be held an oral hearing into the matter and until it has considered the objection and the report of the person who has held the oral hearing. Pursuant to Section 218 of the Planning and Development Act, 2000 (as amended), An Bord Pleanála has an absolute discretion to decide whether to hold an oral hearing into the matter.

- Carlow County Council, County Buildings, Athy Road, Carlow, R93 E7R7, between the hours of 9.15am to 4.30pm on Mondays to Fridays (excluding public holidays) from 3rd December 2024 to 31st January 2025 inclusive.
And at:
- Tullow Library, Inner Relief Road, Tullow, Co. Carlow, R93 XD93, between the hours of 9.30am to 5.00pm on Mondays to Fridays (excluding Wednesdays) and between the hours of 9.30am to 7.30pm on Wednesdays (excluding public holidays) from 3rd December 2024 to 31st January 2025 inclusive.

An application is also being made to the Board under Section 177AE of the Planning and Development Act, 2000, as amended, for which separate notice has been given, and for which a Natura Impact Statement has been prepared in respect of the development which is proposed to be carried out on the lands. The person conducting any oral hearing that may be held in relation to a Compulsory Purchase Order which relates to a development under Section 177AE of the Planning and Development Act, 2000, as amended, is entitled to hear evidence on the likely effects on the environment, the likely consequences for proper planning and sustainable development and the likely significant effects on a European Site.
