Notice is hereby given pursuant to Section 13 of the Planning and Development Act 2000 (as amended) that Carlow County Council, being the Planning Authority for the area, proposes to VARY the Carlow County Development Plan 2022-2028 in respect of the following:
PROPOSED VARIATION No. 1
Borris Small Town
Rezone 1.0ha of land at Scorteen, Borris, Co. Carlow from ‘New Residential’ to ‘Agriculture’ and amend the written text of the Borris Small Town Written Statement to reflect the changes consequent from rezoning.
Rezone 1.7ha at Bog Lane, Borris, Co. Carlow from ‘Strategic Reserve’ to ‘New Residential’ and amend the written text of the Borris Small Town Written Statement to reflect the changes consequent from rezoning.
Reason for PROPOSED VARIATION:
Having regard to Section 653 (1) (a) and (b) of the Taxes Consolidation Act 1997 (as amended) (Residential Zoned land Tax), following receipt of a submission to the draft map in 2023 seeking a rezoning.
Having considered the guidance set out in Circular Letter NRUP 07/2022, the Chief Executive is satisfied that:
The removal of the 1.0ha of residential zoned lands at Scorteen would not undermine the proper planning and sustainable development of the area, including the core strategy and housing supply targets for Borris, having regard to the quantum of residential / mixed use land zoned in Borris in the Carlow County Development Plan 2022-2028.
The lands at Scorteen being located on a peripheral location to the town boundary would not conflict with the goals of compact growth and the ‘sequential approach to zoning’ set out in the Development Plan Guidelines (2022).
The lands proposed for rezoning from ‘strategic reserve’ to ‘new residential’ would support the goals of compact growth and the sequential approach to zoning set out in the Development Plan Guidelines and are appropriately sited to facilitate connection to infrastructure to facilitate development.
Kildavin Larger Serviced Village
Rezone 0.63ha of land at Kildavin, Co. Carlow from ‘Existing Residential / Infill’ to ‘Agriculture’ and amend the written text of the Kildavin Larger Serviced Village Written Statement to reflect the changes consequent from rezoning.
Provide an increase in units deliverable (3no.) on existing New Residential Zoned Land (1.5ha), to ensure flexibility in achieving an appropriate level of housing over the period of the Plan and to amend the written text of the Kildavin Larger Serviced Village Written Statement to reflect the changes consequent from the above.
Reason for PROPOSED VARIATION:
Having regard to Section 653 (1) (a) and (b) of the Taxes Consolidation Act 1997 (as amended) (Residential Zoned land Tax), following receipt of a submission to the draft map in 2023, and the draft annual map for 2025 seeking a rezoning.
Having considered the guidance set out in Circular Letter NRUP 07/2022, the Chief Executive is satisfied that:
The removal of the ‘Existing Residential/Infill’ zoning of these lands would not undermine the proper planning and sustainable development of the area, including the core strategy and housing supply targets for Kildavin, having regard to the increase in unit’s deliverable on existing new residential zoned land in Kildavin in the Carlow County Development Plan 2022-2028.
The existing established use of the site for agricultural purposes.
The preservation of agricultural use in the curtilage of Kildavin House a Protected Structure will support the policy to encourage the reuse of the building and to retain and maintain this important heritage building for future generations.
The lands being located largely within the site boundary of an existing permission associated with a quarry on a larger landholding which remains valid until 2029.
Submissions or observations regarding the Proposed Variation and the associated reports are hereby invited from the public and interested bodies. Children, or groups or associations representing the interests of children, are entitled to make a submission or observation. Written submissions or observations made on or before 5.00pm 5th February 2025 will be taken into consideration before the making of the PROPOSED VARIATION.
