Notice Pursuant to Section 177AE of the Planning and Development Act, 2000 (as amended) and the Planning and Development Regulations, 2001 (as amended).
N80 Leagh Bends Scheme
in the townlands of Graiguenaspiddogue, Castletown, Leagh, Ballybeg, Kilballyhue and Kilcoole.
NOTICE OF APPLICATION TO AN BORD PLEANÁLA FOR APPROVAL
Notice is hereby given that Carlow County Council (“the local authority”) intends to seek the approval of An Bord Pleanála under Section 177AE of the Planning and Development Act 2000, (as amended) to carry out a proposed development along a section of the N80 Road in the townlands of Graiguenaspiddogue, Castletown, Leagh, Ballybeg, Kilballyhue and Kilcoole.
The proposed development known as the N80 Leagh Bends Scheme will consist of:
- Realignment and upgrading of approximately 3.0km of the N80 National Secondary Route between Graiguenaspiddoge and Castletown.
- Realignment of the Graiguenaspiddoge and Castletown Crossroads.
- Diversion of the Kilmeany Stream and replacement of the existing culvert with a new culvert crossing the N80.
- Provision of drainage system including attenuated outfalls.
- Provision of all necessary ancillary civils works and accommodation works.
A Natura Impact Statement (NIS) has been prepared as part of the application for approval in respect of the proposed development.
An Bord Pleanála may give approval to the application for development with or without conditions or may refuse the application for development.
A copy of the plans and particulars of the proposed development and the Natura Impact Statement will be available for inspection free of charge during public opening hours at the following locations:
- Carlow County Council, County Buildings, Athy Road, Carlow, R93 E7R7, between the hours of 9.15am to 4.30pm on Mondays to Fridays (excluding public holidays) from 3rd December 2024 to 31st January 2025 inclusive.
And at:
- Tullow Library, Inner Relief Road, Tullow, Co. Carlow, R93 XD93, between the hours of 9.30am to 5.00pm on Mondays to Fridays (excluding Wednesdays) and between the hours of 9.30am to 7.30pm on Wednesdays (excluding public holidays) from 3rd December 2024 to 31st January 2025 inclusive.
A copy of the plans and particulars of the proposed development and the Natura Impact Statement will be available on the Carlow County Council website www.carlow.ie
Any submissions or observations regarding the proposed development in relation to:
- the implications of the proposed development for proper planning and sustainable development in the area concerned,
- the likely effects on environment of the proposed development, and
- the likely significant effects of the proposed development on a European site, if carried out
may be made in writing to An Bord Pleanála, 64 Marlborough Street, Dublin, D01 V902 during the inspection period. Any submission/observation must be received by An Bord Pleanála no later than 4.00p.m. on 31st January 2025.
In accordance with the requirements of Article 120 of the Planning and Development Regulations, 2001 (as amended) the local authority has carried out a screening determination of the nature, size, location and characteristics of the proposed development and its likely significant effects on the environment and the local authority has concluded that there is no real likelihood of significant effects on the environment arising from the proposed development and a determination has been made that an Environmental Impact Assessment (EIA) is not required.
In accordance with Article 120(3) of the Planning and Development Regulations, 2001 (as amended), where any person considers that the development proposed to be carried out would be likely to have significant effects on the environment, he or she may at any time before the expiration of four weeks beginning on the date of the publication of this notice apply to An Bord Pleanála for a screening determination as to whether the development would be likely to have a significant effect on the environment, stating the reasons for the forming of the view that the development would be likely to have significant effects on the environment and indicating the class in Schedule 5 of the Planning and Development Regulations, 2001 within which the development is considered to fall.
A Compulsory Purchase Order, for which there is a separate public notice, has been made in respect of the development which it is proposed to carry out on the land. If an oral hearing is conducted in relation to the compulsory purchase of land, which relates wholly or partly to the proposed development and in respect of which the local authority has applied for approval, the person conducting any such oral hearing, if any, is entitled under Section 177AE(7) of the Planning and Development Acts 2000 (as amended) to hear evidence on the likely effects on the environment, the likely consequences for proper planning and sustainable development and the likely significant effects upon a European Site.
A person may question the validity of a decision by An Bord Pleanála by way of an application for judicial review under Order 84 of the Rules of the Superior Courts (S.I. No. 15 of 1986) in accordance with Section 50 of the Planning and Development Act 2000 (as amended). Practical information on the review mechanism can be accessed on the Board’s website (www.pleanala.ie) or on the Citizens Information website (www.citizensinformation.ie).
